A family from Guatemala is suing Universal Orlando Resort after 38-year-old Calderon Arana died, accusing the theme park of negligence.
According to the lawsuit, warning signs are displayed only in English but have to be multilingual to let other park goers informed, USA Today reported.
The father passed away in 2016 after riding ‘Skull Island: Reign of Kong.’ According to the lawsuit, Arana did not speak English and had prior heart problems.
After the ride, he had a heart attack and was taken immediately to the hospital, where he passed away.
“Universal was aware of the great number of tourists on their premises who do not speak English,” said the wrongful death lawsuit the devastated family filed.
Skull Island uses animatronics and 3D screens to recreate a truck expedition inspired by King Kong films.
But Arana, who ran a farming operation, felt unwell after riding on the Skull Island. His wife initially thought that he only had an upset stomach.
He sat on a bench while his won and wife went for another side. However, he had collapsed when they returned and he was rushed to a hospital where he died. The lawsuit also claims there was a delay in giving assistance to Arana.
The sign at the entrance of Skull Island says: “Warning! This ride is an expedition through the rough terrain of King Kong’s natural habitat. The movement of the truck is dynamic with sudden accelerations, dramatic tilting and jarring actions.”
It also warns that people with abnormal blood pressure or heart conditions, neck or back conditions, or pregnant women should not go on the ride. Each of the situations has a drawing.
The family’s personal injury attorney, Lou Pendas, said that visitors should be informed on whether they should go on the ride by having warning signs in English, French, Spanish, and other languages.
“This isn’t a crazy request or expectation. It’s actually quite basic in this day and age,” said Pendas. “You are asking for international travelers. This is a mecca for tourism. This is a very basic thing that should be thought of for the safety of patrons.”
