Months ago, we have heard of Jessica Yaniv, a transgender activist who filed a legal case against dozens of female estheticians in Canada after they refused to wax her male genitals.
The BC Human Rights Tribunal has not only tossed Jessica’s case but also ordered the activist to pay $2,000 to several defendants.
The ruling was announced by the Justice Centre for Constitutional Freedoms who represented five businesswomen that Yaniv has targeted.
“The Justice Centre for Constitutional Freedoms (JCCF) is pleased to announce that the BC Human Rights Tribunal has ruled in favor of home estheticians’ right to refuse to handle male genitalia against their will,” JCCF statement read.
As the group revealed, the ruling was based on the fact that “human rights legislation does not require a service provider to wax a type of genitals they are not trained for and have not consented to wax.”
In addition, the ruling explained how Yaniv’s actions were “disingenuous and self-serving” and how she “engaged in improper conduct” to try to push her agenda.
In her lawsuits, Yaniv was demanding to be compensated $15,000 from each of the female estheticians that refused to wax her male genitals.
“The Justice Centre represented Blue Heaven Beauty Lounge and its owner, Sandeep Banipal, who is an adherent to the Sikh religion. Ms. Banipal is not trained to wax male genitals, and as she explained in the response to the complaint against her, it ‘is not something I am comfortable with or trained to do,’” JCCF elaborated, speaking of Sandeep’s case.
As Sandeep confirmed, she was forced to close her home business after Yaniv filed a complaint against her.
Concluding, Jay Cameron of JCCF said that “self-identification does not erase physiological reality. No woman should be compelled to touch male genitals against her will, irrespective of how the owner of the genitals identifies.”
