In the most recent video that has been released to the public, it appears that Toledo drops a handgun before he raises his hands, and then Stillman fires a shot that hits him in the chest, causing the boy’s death.
After the incident, it is shown that Stillman is performing chest compressions in order to prevent the worst from happening, continuing for two minutes before another colleague of Stillman’s comes over to help.
Video footage reveals that he is visibly upset and the other cops comfort him.
Protests started to spark overnight after the video was released from Chicago Police officials. Tom Grace, Stillman’s lawyer, tells the public that he had been faced in a deadly situation since the officer had seen the teenager point a gun at his direction.
Grace writes, “The juvenile offender had the gun in his right hand … looked at the officer which could be interpreted as attempting to acquire a target and began to turn to face the officer attempting to swing the gun in his direction,”
“At this point the officer was faced with a life threatening and deadly force situation. All prior attempts to deescalate and gain compliance with all of the officer’s lawful orders had failed,”
Stillman’s lawyer adds that there was a minimal interest in his own wellbeing, and an officer leaves a statement saying that he has “served his country and his city with honor and deserves our support,”
There were previous reports of “using force” which officers need to file if they use any kind of force while they are on the job. Only one out of the nine resorted to a weapon of some sort, which ended up being a baton.
Stillman has an extraordinary record, receiving a Military Service Award from the Police Department and the Superintendent’s Award of Valor. He is currently now on administrative leave for the time being.
Police responded to the shots being fired in the area, indicating that the 13-year-old had a gun on him before the tragedy occurred. In the footage, there is a sliver of light being shone on the weapon that he possessed.
Earlier, before the shooting had occurred, it seems to appear that the boy threw the gun over the fence before raising his hands up. Once the footage was released, an influx of demonstrations happened around the area.
An attorney for the Toledo family states, “It could be a gun, I’m going to deny that but it’s not relevant, because if he had a gun, he tossed it.”
Another family attorney states that “Those videos speak for themselves. If you are shooting an unarmed child with his hands in the air it is an assassination. His hands were empty when he was shot in the chest at the hands of the officer.”
