35-year-old Michael Virgil boarded the cruise ship Navigator of the Seas with his partner and their seven-year-old son. As per a wrongful death lawsuit that was filed by his partner, Virgil was given at least 33 different alcoholic drinks in a short period of time, while the family was told that their cabin was not ready and asked to wait inside the bar area.

As allegations go, Virgil became so intoxicated that while he tried to locate his cabin, he started to get so disoriented and agitated along the way.

The complaint says he started to act erratically and kicked doors while threatening the crew and other passengers. In reply, the crew and security restrained him in a forceful manner and even used some pepper spray while giving him sedatives to keep him under control this whole time. This was all under the instructions of the ship’s captain, sources alleged.

Medical examiners went on to rule that his death was a homicide, citing mechanical asphyxia due to severe body compression during restraint.

This, combined with serious alcohol intoxication, obesity, and a big heart, is what led to the disaster and ultimately his death. The lawsuit alleges that the staff was negligent and should have stopped serving alcohol when he reached the limit, but they did not, despite him showing serious signs of being intoxicated.
