Many people in the courtroom having a nine member jury confirmed that the song that was sung by Katy Perry and have won 2013 Grammy award for “Dark Horse”, which has impressed the fan base and stood as one of the 100 hottest songs of Billboard in 2014 is actually copied from the Christian song that was composed four years ago.
Marcus Gray and the other two authors of the song named Emanuel Lambert and Chike Ojukwu have filed a complaint against Perry in the year 2014 alleging that the Dark Horse song was copied from the Christian rap song, i.e. “Joyful Noise”, which has hit the music world in 2009 with the stage name “Flame”.
In the Los Angeles Courtroom, the case was declared in favor of Gray by the jury. There was 2 days of rigorous discussions happened on this issue and finally found that the song was a copied version from Joyful Noise.
The defendants in the case are liable to the copyright infringement issues. The notes and beats of the song are completely the focus. However, the lyrics and the recording are totally different.
There are many questions that are probed by the jury for Perry and stated that Perry wants to personally avert liability. The decision that was given by the Court has left many people surprised.
The jury found that all the six songwriters and the four companies who are part of this song are responsible to pay for it, including Perry and Sarah Hudson, who actually wrote the lyrics for the songs and Juicy J is the one who has provided rap to the song.
The producers of the song, namely Dr. Luke, Max Martin and Cirkut are also liable for producing this song.
The jury has finally agreed with the prosecution that half of the song composed and sung by Perry has the same beats and instrumental lines of the rap song that was composed by Gray.
The attorney who is defending for Perry claimed that the allegations are rudimentary for breaching copyrights and pointed that if this is done then the other artists would also be at risk.
The argument of the singer’s lawyer stated that the music alphabets should be available to all to build music. The musical expert was also called to testify the musical patterns that are used in the song.
However, at the end of the case, the argument that was done by Grapy and other plaintiff has won. The jury found that the instrumental lines and beats of the song are same as the Gray song.
The case is now in the penalty phase where the jury is yet to decide the amount that is imposed to be paid by Perry for copyright infringements.
