The female showjumper who sued her mother’s doctor for millions with the claims of how she should have never been born has now won the legal case.
Evie Toombes was born with a condition known as spina bifida, where she spends nearly 24 hours a day connected to an entire system of tubes.
She went on to claim how her mother’s GP failed to give proper medical advice to her mother regarding a list of important supplements to take for healthy baby development, which was what led to her condition.
For this reason, Evie went about suing the medical practitioner that goes by the name Dr. Philip Mitchell, for wrongful conception, in what is being termed as a landmark legal case.
According to the verdict revealed at the High Court Ruling today, many were beyond appalled to witness the young woman win millions in damages for her claims.
Despite spending nearly 24 hours a day, attached to tubes, the young woman never lost hope, and instead opted for her career in show jumping, where she competed against both disabled as well as able-bodied professional riders.
Just last month, she made a unique claim regarding her mother’s wrongful conception, suing her mom’s doctor for millions, but not too many people were hopeful that her case would pull through in her favor. But to their surprise, it did and now the ruling is being referred to as a historic and ground-breaking decision.
While Evie’s lawyers claim that the exact amount that she will receive is yet to be calculated, it is certainly huge.
The judge ruled in her favor because if her mother was advised to take folic acid as supplements, it would have certainly minimized the chances or risk of the child being born with Spina Bifida.point 382 |
