Spears’ lawyer, Mathew Rosengart, filed to remove Jamie Spears’ control over Britney’s estate on Monday. Rosengart asks that control be given to Jason Rubin.

Rosengart says that this request is an “objectively intelligent preference to nominate a highly qualified, professional fiduciary in this circumstance.”

Spears’ conservatorship is temporarily being held by Jodi Montgomery. In a recent hearing, it was decided that her position be extended until October 8.

At the hearing, all parties hoped for a new agreement to pay for Montgomery’s security. Though they did not officially reach an agreement, they did decide to cap the cost at $50,000.

Vivien Thoreen, Jamie Spears’ attorney, was originally unwilling to accept the $50,000 request, however all-parties are now in agreement.

The cost will be re-evaluated in September.

Speaking outside the courtroom, Rosengart says, “Less than two weeks ago, we pledged that, after 13 years of the status quo, my firm and I would more aggressively and expeditiously file a petition to suspend and remove James P. Spears [as conservator].

“It is now a matter of public record and I announced to Judge Penny this afternoon that we have done so in less than two weeks. We look forward to litigating the matter in court.”

There have been several shifts in the on-going battle recently. On Monday, Bessemer Trust’s request to be removed from Spears’ conservatorship was approved by Judge Penny.
